Phenome Longevity
Website and app terms of use
1. Who we are
We are Phenome Longevity Ltd, a company registered in England and Wales under company number 13926236, with our registered office at The Shard, 32 London Bridge Street, London SE1 9SG, United Kingdom. In these terms, "we", "us" and "our" mean Phenome Longevity Ltd, and "you" means anyone using our services.
These terms apply to:
- our website, phenomelongevity.com;
- our kit activation and account portal, phenomeportal.org; and
- the Phenome Longevity app for iOS and Android,
together called our "services". You can contact us at hello@phenomelongevity.com. Our team answers within one working day.
2. Accepting these terms
By using our services, or by creating an account, you agree to these terms. If you do not agree, please do not use our services.
These terms work alongside our Privacy Policy and Cookie Policy, which explain how we use your personal data and cookies. If you buy anything from us, our Terms of Sale also apply. Where the Terms of Sale and these terms differ about a purchase, the Terms of Sale apply.
If you downloaded the app from the Apple App Store or Google Play, their rules also apply to your use of the app.
Additional terms for the Apple App Store: If you downloaded the app from the Apple App Store:
- these terms are between you and us, not Apple, and we, not Apple, are responsible for the app and its content;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund any purchase price you paid for the app. Apple has no other warranty obligation for the app;
- Apple is not responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal requirements, consumer protection or privacy claims, or claims that the app infringes someone’s intellectual property;
- you must comply with any applicable third-party terms when using the app; and
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.”
3. Who can use our services
Our services are for adults aged 18 and over. You must not create an account if you are under 18.
The only exception is the Newborn Screening Test. A parent or legal guardian may activate this test, provide the baby's sample and hold the baby's results within their own account. By doing so, you confirm that you are the baby's parent or legal guardian and that you give consent on the baby's behalf.
4. Your account
When you create an account, you agree to:
- give accurate and complete information, and keep it up to date;
- have only one account, which is for you alone;
- keep your password and login details safe and not share them with anyone; and
- tell us at once at hello@phenomelongevity.com if you think someone else has accessed your account.
Each person who takes a test or uses a device needs their own account with their own email address. This includes family members, partners and friends you buy a kit for. Results are linked to the person who activated the kit, so please do not activate a kit for someone else under your account (except a Newborn Screening Test for your baby).
You are responsible for activity on your account unless it happens because of our failure to keep our systems secure.
5. Health information: please read
Everything we provide through our services, including website content, test reports, trends, dashboards, Longevity AI insights and wearable readings, is wellness information for general purposes. It is not medical advice and is not diagnostic. It does not diagnose, treat, cure or prevent any disease, and it is not a substitute for advice from your doctor or another qualified healthcare professional.
- The PhenomeTech Ring and PhenomeTech Band are wellness devices, not medical devices.
- Readings such as heart rate, heart rate variability, sleep and movement are estimates.
- Blood pressure and blood oxygen (SpO2) readings are estimates only. They must not be used to diagnose or manage any medical condition, such as high blood pressure or a breathing condition. Use a medical device and follow your doctor's advice for that.
- No laboratory test is 100% accurate.
Please talk to your doctor before making any significant change to your medication, diet, exercise or treatment based on our services, and never ignore or delay medical advice because of something you have read on them. If you feel unwell or are worried about your health, seek medical help. In an emergency, call 999.
6. Longevity AI and automated insights
The app uses algorithms, including our Longevity AI feature, to give you personalised insights and suggestions based on your results, questionnaire answers and wearable data. Please bear in mind that:
- automated insights can be incomplete or wrong, and depend on the accuracy of the information and data they are based on;
- they are general wellness suggestions, not medical advice or a diagnosis; and
- we do not use them to make decisions that have legal or similarly significant effects on you.
If you have a question about an insight, you can ask for it to be reviewed by a member of our team by contacting hello@phenomelongevity.com or our Data Protection Officer at info@phenomelongevity.com. Our Privacy Policy explains how we use your data for these features and your rights.
7. Acceptable use
You must use our services lawfully and in line with these terms. You must not:
- use our services for any unlawful, fraudulent or harmful purpose;
- submit a sample that is not yours, or activate a kit for another person under your account (except a Newborn Screening Test for your baby);
- pretend to be someone else or give false information;
- access, or try to access, another person's account or data;
- copy, modify, decompile, reverse engineer or try to extract the source code of the app or our software, except where the law allows this;
- use automated tools such as robots, scrapers or crawlers to collect content or data from our services;
- introduce viruses or other harmful code, or try to interfere with, overload or break the security of our services;
- use our services, content or reports to build a competing product, or for commercial purposes without our written permission; or
- post or send content that is offensive, defamatory or infringes anyone's rights.
8. Intellectual property and your licence
We, or our licensors, own all intellectual property rights in our services, including the app, software, text, designs, images, logos, reports and the Phenome name. These rights are protected by law.
We give you a personal, non-exclusive, non-transferable, revocable licence to use the website and to download and use the app on devices you own or control, for your own personal, non-commercial use, in line with these terms. You may view, download and print your own reports for personal use, including to share with your doctor.
You must not copy, distribute, sell or publish any part of our services without our written permission, except as these terms allow.
9. Your content and data
Your results, questionnaire answers and wearable data are yours to control. We use it only as described in our Privacy Policy. We never sell your data, and we never share it with employers or insurers. We only use your data for research if you give separate consent, which you can withdraw at any time.
If you send us feedback or suggestions, we may use them to improve our services without any obligation to you.
10. Third-party integrations
You can choose to connect the app to third-party services such as Apple Health and Google Fit, and to your PhenomeTech devices via Bluetooth. When you connect a third-party service:
- you control what data is shared, and you can disconnect at any time in the app or in the third-party service's settings;
- the third party's own terms and privacy policy apply to its service; and
- we are not responsible for the availability, accuracy or content of third-party services.
11. Availability and changes to our services
We work to keep our services available and secure, but we do not guarantee they will always be available, uninterrupted or error-free. We may suspend access for maintenance, security or reasons outside our control. We will try to give you notice of planned interruptions.
We may update or change our services, for example to add features, reflect changes in the law or fix problems. You may need to install updates to keep using the app. If we stop providing a feature you have paid for, or make a change that significantly affects something you have paid for, we will tell you and your rights under the Terms of Sale will apply. We will always give you a way to access or download the results of tests you have bought.
12. Suspending or closing accounts
We may suspend or close your account if you seriously or repeatedly break these terms, if we reasonably suspect fraud or misuse, or if we are required to by law. Where it is reasonable to do so, we will tell you first and explain why. If we close your account, we will give you a reasonable opportunity to download your results, unless the law prevents this. If you have paid for something you have not received because we closed your account without good reason, we will refund you.
13. Deleting your account
You can stop using our services at any time. “You can delete your account in the app at Profile > My Account > Deactivate account, or by emailing hello@phenomelongevity.com from the email address linked to your account. We may need to confirm your identity first.
Before you ask us to delete your account, please download any reports you want to keep, as you will not be able to access them afterwards. Some information may be kept for a set period where the law requires it, for example order and billing records, and laboratory data kept for quality and audit purposes. Our Privacy Policy explains what we keep and for how long.
14. Links to other websites
Our services may contain links to other websites and resources. These are for your information only. We do not control them and are not responsible for their content or how they use your data.
15. Our responsibility to you
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law, including your rights as a consumer.
Our services are for domestic and private use. We are not responsible to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
If digital content we supply damages a device or digital content belonging to you because we did not use reasonable care and skill, we will either repair the damage or pay you compensation. We are not responsible for damage you could have avoided by following our advice to install a free update or by following the minimum system requirements.
16. Changes to these terms
We may update these terms from time to time. We will show the date of the latest version at the top of this page. If we make a significant change, we will tell you by email or in the app before it takes effect. If you do not agree with the change, you can stop using our services and delete your account.
17. Complaints
If you have a complaint about our services, please see our Complaints Policy.
18. Other terms
Other important terms.
- We may transfer our rights and obligations under these terms to another organisation. We will tell you if this happens, and we will make sure the transfer does not reduce your rights under these terms.
- You may only transfer your rights or obligations under these terms to another person if we agree in writing.
- Nobody else has any rights under these terms.
- Each section of these terms operates separately. If a court decides that any part is unlawful, the rest will remain in full force.
